1. Agreement

By accessing or using Trader Tone ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service.

2. Description of Service

Trader Tone is an automated cryptocurrency trading platform that executes trades on your behalf using strategies you configure. The Service includes a web dashboard, mobile app, AI advisor, and background workers that execute trades via your connected exchange API keys.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction, including cryptocurrency trading regulations.

4. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Ensuring your exchange API keys have appropriate permissions (trade-only, no withdrawal).
• Monitoring your strategies and responding to alerts.
• Setting appropriate risk limits for your financial situation.

5. API Keys and Private Keys

When you connect exchange API keys or wallet private keys to the Service:

• Keys are encrypted with AES-256-GCM and stored securely. We cannot view, access, or decrypt your stored credentials.
• You should only grant trade permissions. Never grant withdrawal permissions.
• For DEX strategies (Cross-Chain DEX Arb) and Polymarket strategies, we strongly recommend creating a dedicated wallet specifically for trading. Never use your main wallet. Fund it with only the capital you intend to trade.
• You acknowledge that providing a private key carries inherent risk and accept full responsibility for the security of your wallet.

6. Risk Disclosure

Cryptocurrency trading involves substantial risk of loss. You should carefully consider whether trading is suitable for you in light of your financial situation. Key risks include:

• Market Risk: Cryptocurrency prices are highly volatile and can move sharply against your position.
• Strategy Risk: No trading strategy guarantees profits. Historical performance does not predict future results.
• Technology Risk: Software bugs, API failures, network outages, and blockchain congestion can result in failed or delayed trades.
• Exchange Risk: Your funds on exchanges are subject to the exchange's solvency, security, and operational risks.
• Bridge Risk: Cross-chain strategies involve bridge custody risk during the transfer period.
• Liquidity Risk: Trades may not execute at expected prices in illiquid markets.

7. No Guarantee of Performance

Trader Tone does not guarantee any level of return or performance. Estimated returns shown on the website are based on historical data and live monitoring — they are illustrative only and do not guarantee future results. You may lose some or all of your invested capital.

8. Limitation of Liability

To the maximum extent permitted by law, Trader Tone and its operators shall not be liable for:

• Trading losses incurred through the use of the Service.
• Losses due to exchange outages, API failures, or network issues.
• Losses due to incorrect strategy configuration by the user.
• Indirect, incidental, or consequential damages of any kind.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Subscriptions and Payment

• Core Plan: $29/month or $290/year. Includes 2 strategies (Funding Rate Arb, Trend Following), 1 exchange connection, 1 daily AI report.
• Pro Plan: $99/month or $990/year. Includes all 8 strategies, unlimited connections, 2 daily AI reports, AI chat, and priority support.
• Monthly plans may be cancelled at any time.
• Annual plans are refunded pro-rata for unused full months upon cancellation.
• Prices are subject to change with 30 days notice.

10. Acceptable Use

You agree not to:

• Use the Service for money laundering, fraud, or any illegal activity.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Interfere with the operation of the Service or other users' accounts.
• Share your account credentials with third parties.
• Use the Service to manipulate markets or engage in wash trading.

11. Intellectual Property

All code, algorithms, strategies, designs, and content of the Service are the intellectual property of Trader Tone. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for personal trading purposes only.

12. Termination

We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or fail to pay subscription fees. Upon termination, all active strategies will be stopped and your encrypted API keys will be destroyed.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Ireland.
